By accessing or using Flicks ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions, you may not access or use the Service.

2. Description of Service

Flicks is a content discovery and media streaming platform that aggregates links to video content available on third-party sources across the internet. Flicks does not host, upload, or store any video files on its own servers. All media content is provided by and sourced from external third-party services.

3. User Accounts

To access certain features of the Service, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating your account. You agree to notify us immediately of any unauthorized use of your account.

4. Third-Party Content

Flicks provides access to content from third-party sources. We do not control, endorse, sponsor, or assume responsibility for any content provided by third parties. Your use of third-party content is at your own risk. You acknowledge that Flicks is not responsible for the availability, accuracy, or quality of third-party content.

5. Acceptable Use

You agree not to use the Service for any unlawful purpose or in any way that could damage, disable, overburden, or impair the Service. You agree not to attempt to gain unauthorized access to any portion of the Service. You agree not to use automated systems or software to extract data from the Service.

6. Intellectual Property

The Flicks name, logo, and all related names, logos, product and service names, designs, and slogans are proprietary to Flicks. The content metadata displayed on the Service, including but not limited to movie titles, descriptions, and poster images, is sourced from The Movie Database (TMDB) API and is subject to their respective terms of use.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. FLICKS DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. FLICKS DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

8. Limitation of Liability

IN NO EVENT SHALL FLICKS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF THE SERVICE.

9. Modifications

Flicks reserves the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

10. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation if you breach the Terms.

11. Governing Law

These Terms shall be governed and construed in accordance with applicable laws, without regard to conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
